A major figure in the criminal underworld, Tony Mokbel, has dodged a return to prison, sparking a complex legal saga. This case delves into the murky world of drug trafficking and the integrity of the justice system. Mokbel, a man known for his influence, was facing the possibility of more jail time. But why? At the heart of the matter is Mokbel's involvement in trafficking over 41 kilograms of methylamphetamine. He had challenged his conviction from 2006, arguing that his case was compromised by his former barrister, Nicola Gobbo. Gobbo, it turned out, was secretly working as an informer for the police, a fact that would later become a major point of contention.
In October, the Victorian Court of Appeal made a crucial decision. They rejected Mokbel's appeal regarding the drug-trafficking charge, which was part of a police operation known as Magnum. Instead, the court upheld his conviction. Justices Stephen McLeish, Maree Kennedy, and Stephen Kaye re-sentenced him to 13 years, seven months, and 15 days in jail. The catch? Mokbel had already served this time, meaning he wouldn't be returning to prison. You can imagine his relief!
But here's where it gets controversial... Mokbel also appealed two other convictions, known as Quills and Orbital. The court found that Gobbo, while acting as a police informer, had encouraged two of her clients to testify against Mokbel. Simultaneously, she was representing him in court, creating a significant conflict of interest.
The court determined that the evidence provided by one of Gobbo's clients, identified as Mr. Bickley, led to a substantial miscarriage of justice. As a result, Mokbel's conviction on the Quills drug trafficking charge was overturned. The Orbital drug importation conviction was also set aside, but the justices decided Mokbel should face a retrial for this charge.
The Victorian Director of Public Prosecution is currently considering whether to retry Mokbel on the Orbital charge.
